Onyango Oloo now moves to court to challenge his impeachment

Ousted Kisumu Speaker Onyango Oloo has moved to court to challenge his removal from the county assembly as he begins battle to save his seat.

In an application filed under a Certificate of Urgency, Mr Oloo (pictured) has sought six orders including stopping the county assembly from implementing a resolution to impeach him.

Oloo wants the Labour and Employment Court to issue orders reinstating him as speaker pending the hearing and determination of his application.

The county assembly, on the other hand, has also filed a petition seeking to compel Oloo to return county assets in his possession, including a vehicle.

In his suit, Oloo claims that his impeachment was marked by a series of breaches to the law and he wants the court to overturn the assembly's decision.

He is also fighting for reinstatement of the benefits, allowances and privileges that he has always enjoyed as Speaker.

The County Assembly and County Assembly Service Board have been listed as respondents in the suit while acting Speaker Elisha Oraro is listed as an interested party.

According to the embattled former Speaker, the process of his removal was unconstitutional. Oloo was impeached on September 18 after ward representatives raised a number of allegations against him.

“The county assembly illegally removed me from office without affording me an opportunity to defend myself and respond to the allegations raised against me,” reads his petition.

Oloo claims that Oraro's election contravenes the provisions of Article 178 (1) of the Constitution, arguing that Oraro is a sitting member of the county assembly.

He also accuses the officer in charge of Kisumu Central Police Station of helping the county assembly to bar him from accessing his offices.
