Woman denied bail, remanded for receiving Sh6 million through false pretence

A Nairobi court has remanded a woman for allegedly obtaining Sh6 million by pretending that she could clear building materials from Mombasa Port.

Edna Adhiambo Odoyo however, denied the charge before Milimani Chief Magistrate Hannah Ndungu and was remanded at Central police station to allow police complete investigations.

Prosecutor Eddie Kadebe urged the court to not release the suspect on bail, saying police had not completed investigating the matter since Ms Odoyo was arrested over the weekend.

“It is the prosecution’s request that the accused is likely to interfere with ongoing investigations if released on bail. I urge the court that she be remanded for another two days since crucial information from the banks on when and where the alleged transactions took place have not been completed,” Kadebe argued.

According to the charge sheet, Odoyo, who was arrested last week on Friday, was accused that with the intent to defraud Maslows Kenya Limited, she obtained Sh6,390,300 on diverse dates between May 17 and June 24,2014, jointly with others.

Bond terms

The charge further stated that Odoyo claimed she was in a position to clear assorted merchandise for construction sent by one Renish Achieng from China, which was stalled at the port of Mombasa, a fact she knew to be false.

The suspect through her lawyer Chris Omolo requested the court to release her on lenient bond terms, saying she was not a flight risk.

“My client has been in custody and I believe she cannot bar the investigators from obtaining any information they require. I urge the court to release her on lenient bond terms as she is ready to abide by any condition imposed by the court,” Omolo told court.

However, the chief magistrate upheld the prosecution’s request, saying there was a possibility of the suspect interfering with ongoing investigations. She directed the suspect to remain in custody until Wednesday, when the court will revisit her application for bail. The case will be heard on March 24.
