Fired Del Monte staff to get Sh1.2m for wrongful dismissal

The Employment and Labour Relations Court has ordered Del Monte Kenya Limited to pay a former employee Sh1.2 million for wrongful dismissal.

Documents filed in court indicate Moses Omutanyi Mumia, then a general field worker, was dismissed from the pineapple processing company in 2013, after working for 12 years, after the firm allegedly discovered a Sh5 million loss in its books of accounts.

The court heard that Mumia's job included receiving pineapples from the farm supervisor, weighing them and issuing them to customers as per orders given by the sales supervisor.

Justice Byram Ongaya yesterday noted that the company had failed to establish the plaintiff failed to perform any of the duties he was supposed to perform.
