High Court upholds election of Mutua as Machakos County Governor

MACHAKOS, KENYA: The High Court sitting in Machakos has upheld the election of Dr.Alfred Mutua as the governor of Machakos County.

High Court Judge Justice David Majanja dismissed the petition challenging the election of Dr.Mutua in the March 4 general election for lack of credible evidence.

Former assistant minister Wavinya Ndeti had moved to court seeking the nullification of Dr.Mutua’s election, citing massive electoral malpractices.

“I declare that Dr.Alfred Nganga Mutua was validly elected Governor of Machakos”, said Justice Majanja before a packed court room.

Dr.Mutua who was represented by Makueni Senator Mutula Kilonzo Junior was present during the ruling that lasted over one hour.

He was accompanied by his deputy Bernard Kiala,the entire county executive committee and a host of supporters.

Wavinya who was also present during the judgment had argued Dr.Mutua was not validly elected citing errors in Forms 35 which Justice Majanja dismissed saying they were not substantial to alter the final result.

The Judge ordered Wavinya to meet the cost of the suit in which Dr.Mutua will take home Sh2 Million while the other three respondents will pocket a total of Sh7m.
