Hate speech: Video gives Dor away

There is evidence to prove that Nominated MP Mohamed Dor committed a crime by uttering inciting words against the Government, a Mombasa court was told on Thursday.

The MP is accused of inciting disobedience to laws, according to the charge sheet displayed on Thursday while he was initially indicted for incitement to violence when he was arrested in Nairobi last month.

Inspector Zeleah Jaka told Mombasa Chief Magistrate on Thursday that she personally heard the MP saying he was ready to finance MRC if asked to do so.

“I heard Sheikh Dor say that he is ready to finance MRC if they ask him to do so,” said Inspector Jaka, who was being led in evidence by State lawyer Alex Muteti.

She told the court that the MP made the remarks while addressing a press conference immediately after launching Unity Party of Kenya at Chandaria Hall in Mombasa.

The MP has denied that on October 13 at Mombasa Technical Training Institute at Tononoka area, he said he would finance MRC if they asked him to.

The inspector told the court that the MP uttered these words following a question he was asked by the Press.

“I heard him utter these words while standing five metres away from where he was addressing the reporters after he had completed launching his political party,” she said.

Lawyers Mwita Chacha and Stephen Mwenesi are representing Dor.

Mr Muteti said the prosecution will call six witnesses.

One of the witnesses, Corporal Michael Musa, also told the magistrate that he also heard Dor utter the words.

Confirm words

Musa admitted there was no violence in the hall because of police presence.

Video clips of what the MP said on the material day was played in the court after being produced by the Communication Commission of Kenya.

Musa confirmed that the words from the clips were the same words Dor uttered on the material day.

Dor now faces the fresh charge of uttering words indicating it was desirable to disobey the law and is out on a bond of Sh1 million.
