A 75-year-old man charged with attempted defilement told a court on Wednesday that his wife had denied him sex for more than eight years.
Kipngeno arap Bor told Nakuru Principal Magistrate Joe Omido that on the night he is accused of trying to defile an 11-year-old girl, he had planned to have sex with his wife.
He had asked his wife to take his food to his room but she instead sent the minor, he said.
The man added that his plan was to lock his wife in his room and spend the night with her.
The minor had just opened the door when the old man grabbed her thinking it was his wife. The terrified girl screamed for help.
Mr Bor is alleged to have committed the offence on the night of September 24, 2017 in Subukia.
He also faces an alternative count of engaging in an indecent act with the minor as he is accused of touching the girl’s private parts.
A report presented in court indicated the man was busted committing the offence by his wife, who was responding to the girl’s distress call.
The magistrate said the court had noted the man’s sentiments.
The court released him on a Sh200,000 bond, with no objection from State prosecutor Sandra Kosgey.
According to Kenya’s Sexual Offences Act, a person who commits an offence of attempted defilement with a minor is liable upon conviction to imprisonment for a term of not less than ten years.
The hearing continues on November 6.
