Agriculture PS, wife sued for allegedly blocking access road

Agricuture Principal Secretary Paul Ronoh [File,TheStandard] Agriculture Principal Secretary Paul Ronoh and his wife, Betty Chepkorir, are embroiled in a legal dispute with their neighbours over an access road. The neighbours have filed a lawsuit against Ronoh and his wife, alleging that they have obstructed the access road leading to their homes. Kipsuge Soi and his wife Caroline Soi, and Koskei Kiprotich, in a suit filed at the Kericho magistrate's court through lawyer Owen Mutai, said they are registered owners of three parcels of land known as KERICHO/CHEPSIR S. S/204, KERICHO/CHEPSIR S. S/155 and KERICHO/CHEPSIR 506, which are situated in the Chepsir area within Kericho County. Soi and his wife claim they obtained registration as proprietors of the said parcels of land on March 31, 2004, and September 1, 2006, and established a residential house and a tea farm, as well as a dairy farm through which they generate an income. Kiprotich said he obtained registration of his parcel of land, being KERICHO/CHEPSIR 506, on October 28, 2020, and developed it by establishing a residential house and conducting small-scale agricultural activities. To access the said parcels of land, the three, as well as their neighbours, said they use a public access road that runs through a parcel of land referred to as KERICHO/CHEPSIR S.S/20,5, dividing it into two portions. The said parcel of land is registered in the name of PS Ronoh, and his wife resides there. Soi and Kiprotich claim the public road was established in 2004 when Mr Samuel Mutai subdivided his land, and it was then purchased by Soi and his wife. "The access road is also clearly marked and identified on the Registry Index Map for the area and therefore forms part of the legal access network as per the Physical and Land Use Planning Act," read the suit in part. Soi, his wife, and Kiprotich claim that the PS's wife, on January 6, 2025, blocked the road using wooden posts, barbed wire, and tree branches. They stated that they have suffered anxiety, stress, damage, and loss as they are unable to enjoy the possession, occupation, and use of their land. The PS and his wife said they have blatantly ignored their requests to cease interfering with the said access road. They want the court to issue orders compelling the PS and his wife to remove any obstructions blocking the access road. On February 20, 2025, Principal Magistrate F M Nyakundi issued temporary orders restraining the PS and his wife from obstructing the use of the access road pending hearing and determination of the case. Ronoh and his wife, in their defence, dismissed the claim of the existence of an access road crossing in the middle of their parcel of land. On Thursday, Kericho Senior Resident Magistrate Japheth Bii issued orders that a site visit on the parcels of land will be conducted on September 4, 2025. The site visit will be conducted following consent by the parties. The visit will be conducted in the presence of the County Surveyor, Kericho, and/or the District Land Registrar to guide the court as to the location and status of the suit parcels.
