High Court urged to kick MCA out of office for 'sex abuse of children'

Residents of a ward have asked the High Court to declare their MCA unfit to hold office for allegedly sexually abusing children.

Besides sexual abuse, they also allege that John Lepil Lolkile, the Angata Nayukie MCA, has been involved in illicit marriages and forgery in their petition filed before Nakuru Resident Judge Maureen Odero.

The residents jointly with the East African Centre For Justice (EACJ) want the Independent Boundaries and Electoral Commission (IEBC) to avail the documents presented by the MCA for clearance when he vied for the position.

They also want the court to declare that Mr Lolkile has violated the rights of minors and the electorate and that he is unfit to hold office.

The petitioners want five minors escorted by Maralal Police OCS to hospital for medical examination and DNA tests conducted on children allegedly fathered by the MCA.

According to the petitioners, the minors who were impregnated by the MCA include a 16-year-old who gave birth in 2008. Two other girls allegedly gave birth in 2014 and 2015.

Lacks integrity

The MCA is entangled in four other suits filed by his former wife Elisabeth Winkel, a Dutch woman, who he married in 2008 before their marriage fell apart in 2013.

This is the reason the petitioners have accused the MCA of bigamy. The two were later granted a divorce but suits relating to custody of children sired by a Samburu woman are still in contest.

Ms Winkel claims there was an agreement with Lolkile to have the children out of the wedlock so that she could adopt them as she was unable to give birth. The biological mother has denied knowledge of such an agreement and refused to give up her three children.

IEBC, the Ethics and Anti-Corruption Commission and Attorney General are interested parties in the case.

EACJ claims it was undertaking civic education when it received complaints from the elders concerning the leader, who they claim was disrespectful to the electorate.

Through Lawyer Kenneth Mbaabu, the petitioners claim the MCA uses a name (John Lepil Lolkile) other than the one they know John Lemulugo.
