Suspended Deputy Chief Justice, Nancy Baraza has resigned and withdrawn her appeal to the Supreme Court.

Baraza, who was accused of assaulting a security officer at the Village Market on December 31st last year, was suspended following a tribunal’s recommendation which termed her actions as “gross misconduct and misbehavior”.

The suspended DCJ had launched an appeal on the tribunal’s ruling wanting the Supreme Court to overturn the tribunal’s recommendations and findings stating that they could not form the basis of her removal from office.

The suit was to be heard by a five-judge Bench comprising Chief Justice Willy Mutunga, judges Smokin Wanjala, Jackton Ojwang, Philip Tunoi and Njoki Ndung’u.
