Troubled supermarket contests Sh74 million arrears in rent row

Nakumatt Supermarket has denied owing its former landlord, Ideal Location Limited, rent arrears and accruing profits totaling Sh74,438,765.

Nakumatt’s administrator Peter Kahi told Justice Charles Yano in Mombasa that there were already orders issued by Nairobi High Court Insolvency Cause barring landlords and creditors from evicting and selling off Nakumatt assets pending the insolvency matter. “Only rent payments in respect of the months falling after administration order are legally payable to the landlord and it would be grossly unacceptable to levy execution for rent payment for the period preceding issuance of administration order given on January 22 2018,” said Mr Kahi.

Kahi said the landlord had alleged the amount as outstanding arrears, while cunningly lumping together alleged pre-administration and post-administration arrears.
