MP tells court rival is a lunatic, killed his brother

Proceedings in an election petition turned ugly when an MP accused his political rival of killing his own brother.

Kamukunji MP Simon Mbugua further claimed that the petitioner, Mr Ibrahim Ahmed, committed the offence in 1995 when he was mentally unstable.

Presiding Judge Mary Ang’awa, however, expunged the allegations from the court record following an objection by Ahmed’s lawyer Steve Owino.

But the MP’s lawyer Kibe Mungai maintained he had the right to ask the witness any question in cross-examination. And when Justice Ang’awa overruled him Mungai told the petitioner that by the time he was registered to vote before 2007, he was a lunatic and in law should not be a voter.

Ahmed answered: "I have never been charged with any other criminal offence other than incitement and I was acquitted. I am hearing for the first time in this court that I murdered my brother and that I am a lunatic." Hearing continues.
