Woman sues businessman Jimnah Mbaru for child neglect

A woman has filed a case against businessman Jimnah Mbaru for his alleged failure to provide financial support for their child.

According to court documents filed before the Nairobi Children's Court, Elizabeth Kamiti, the mother of the child, accuses Mbaru of denying the child's identity by omitting his name from the child's birth certificate.

She claims the two were involved in an affair in 2017 from which she conceived and bore the minor in July 2018.

"Our instructions are that you are the biological father of the child and that on or about September 1 2020, you instructed or gave power of attorney to Eric Kaburu to be a putative father to the minor," she said in a demand letter signed Mugeria, Lempaa & Kariuki Advocates dated July 28, 222.

According to Kamiti, Kaburu was supposed to pay Sh50,000 monthly for the child's upkeep under a Memorandum of Understanding (MoU) dated September 10, 2020, an amount she claims has not been remitted.

She now wants Mbaru to be compelled to provide Sh600,000 yearly for the child's school fees and a further Sh320,000 monthly for upkeep and wants him compelled to take care of the child as his biological father.

The sum will cover expenses such as food and shopping, rent, security, clothing and housekeeping, entertainment, medical coverage, education, transportation, and utilities.

Kamiti claims Mbaru is an astute businessman who runs businesses worth billions of shillings and is, therefore, able to support the child without difficulty.

She also wants a DNA conducted and the putative father restrained from holding himself as a putative father to the minor as it will affect the mental, physical, and emotional well-being of the child.
