Lobby asks Maraga to review Supreme Court’s nullification of Uhuru’s re-election

A petitioner has written to the Chief Justice to review the Supreme Court's nullification of President Uhuru Kenyatta's re-election, citing interference.

In a letter to Chief Justice David Maraga on Tuesday, Angaza Network Director Derrick Malika demanded that the CJ should constitute a fresh bench to reconsider the evidence given by President Uhuru Kenyatta, the Independent Electoral and Boundaries Commission and Opposition leader Raila Odinga.

“Without prejudice to the foregoing, we wish to petition your office to immediately convene the Supreme Court bench with a view of reviewing the decision,” wrote Mr Malika.

The lobbyist's petition may however bear no fruit as Mr Maraga, his deputy Philomena Mwilu and Justice Isaac Lenaola would have to disqualify themselves over allegations facing them.

This would leave justices Njoki Ndung’u, Jackton Ojwang, Smokin Wanjala and Mohamed Ibrahim.

The four would not meet the quorum of five set by the Constitution, thus the decision made early this month will stand.

The first petition filed before the Judicial Service Commission by Nyeri Town MP Ngunjiri Wambugu alleged the CJ had a hand in "instituting a judicial coup".

Malika alleges Ms Mwilu and Mr Lenaola communicated with Raila's lawyers during his petition hearing.
