Taj Mall managing director Rameshchandra Govind Gorasia has moved to the High Court to stop his prosecution over alleged fraud.

In his application, Gorasia accused Director of Public Prosecutions Keriako Tobiko of malice, after claims he forged two titles for land in Embakasi, Nairobi, surfaced.

In the case filed under a certificate of urgency by Mungai Kalande and Company advocates, Gorasia claimed he was the genuine owner of the contested land, having acquired it on April 9, 1996.

He stated that another firm, Siesta Investment, which is also claiming ownership of the land, fraudulently acquired its titles, although it has not been investigated.

"Taj Mall Ltd is the registered proprietor of that property known as LR No 20273 in Embakasi, Nairobi County," the court papers read.

Gorasia wants the case stopped. He is expected before court to answer to forgery claims.
