Administration Police officer is guilty of murder, State counsel says

A State lawyer has said an Administration Police officer suspected to have shot dead a villager in Lamu eight years ago is guilty of murder.

George Murithii yesterday told Justice Maureen Odero that the prosecution had proved that Cpl Danson Mungunya was the one who shot Mselem Mohamed Ali dead at Mbwajumali village eight years ago.

"The prosecution witnesses have proved their case. You will note that the cause of the death was a bullet, which shattered the brain of the deceased," said Mr Muriithi.
Murithii said this in his submission in a case Mugunya has denied murdering Ali on May 21, 2006 at Mbwajumali village, Kizingitini in Lamu County.
Mugunya was jointly charged with Kizingitini Chief Kassim Shee Mbwana, who died before trial was concluded.
In his defence, Mugunya claimed Mselem died after hitting his head on a concrete of sewage where he had fallen while trying to escape arrest.

The judgement was scheduled for November 28.
