It's 15 years for man who killed brother over Sh10

NAKURU COUNTY: A man who stabbed his brother to death over Sh10 has been spared the hangman's noose after a lesser charge of manslaughter was preferred by a Nakuru High Court.

David Semetei Ekuru had confessed to killing his brother Robert Emana but Justice Anyara Emukule Thursday reduced the charge, saying the accused had been provoked.

"The court has established that you were provoked. You nonetheless reacted in an unnecessary manner and I therefore find you guilty of manslaughter and sentence you to 15 years in prison," the judge ruled.

The court had earlier heard through Police constable Joseph Leshula that the accused stabbed his brother over the said money following a disagreement.

Leshula said a witness, Gilbert Juma, who was present at the scene told police that Semetei and Emana had bet the money over a game they were playing.

"However, after losing the game, the deceased refused to part with the money and instead accused his brother of acting dishonestly," the constable said.

He said Semetei would not back down on his demand his brother keep his end of the bargain and this enraged Emana who drew out his belt and mercilessly whipped Semetei.

POLICE SEARCH

In retaliation, the accused reached for his sweater, which was a few meters away, drew out a knife and stabbed the deceased thrice, on the neck, chest and abdomen, killing him on the spot before fleeing.

Leshula told the court police launched a search for Semetei and finally apprehended him in Mogotio and also recovered the knife from him.
