Man jailed 15 years for defiling and impregnating a 16 year old girl

A twenty one year old man has been jailed for 15 years by a Naivasha court after he was found guilty of defiling and impregnating a 16 year old girl.

The accused James Kahora Gathuru broke into tears after DNA results indicated that he was 99.99 percent the father of the minor sired after the attack.

In his ruling Naivasha Chief Magistrate Stephen Githinji said that the DNA results had pinned down the accused.

The magistrate noted that the evidence adduced in the court proved beyond reasonable doubt that the accused had committed the act.

He further noted that when the accused was placed on his defense he remained mute despite having demanded a DNA test.

In the case, Kahora had been charges that on the 13th of August 2010 in Kitiri Nyandarua County he had carnal knowledge of the minor.

The accused who was unrepresented faced an alternative charge of indecently assaulting the girl by touching her private parts.

In mitigation, the accused acknowledge that the sired minor was his and promised that he was ready to take care of it.

The court could hear none of this and gave him the 14 days right of appeal. Earlier the court heard how the accused who is neighbor to the complainant visited her home to borrow a matchstick box.

He later turned against her and raped her for over 20 minutes with threats of death if she revealed the ordeal to anyone.

The form one girl kept quiet but a few weeks after returning to school she got sick and on examination is was discovered she was pregnant.

She tried to commit suicide by taking a poisonus substance and it was during the ordeal that she revealed what had happened.
