Akinyi wins first round in resort dispute suit

Businesswoman Joyce Akinyi can rest easy for now after a court dismissed an application to wind up a popular resort.

Her estranged husband Anthony Chinedu had applied to have the New Deep West resort, which they owned jointly, sold.

But yesterday, Justice Martha Koome ruled his petition was bad in law and failed to explore other means of settling the issue.

"He should seek other remedies by offering to share in the company rather than pushing for a winding up, which should be the last option," the judge ruled.

Mr Chinedu moved to the court last July, seeking to wind up the resort. He wanted the proceeds shared between him and Ms Akinyi in a ratio to be decided by the court.

He argued their relationship had deteriorated beyond repair and he could no longer trust Akinyi.

But the court dismissed his application on grounds he did not establish a clear case for an interim injunction against Akinyi.
