The court has ordered a West African businessman embroiled in a tussle with wife Joyce Akinyi to pay school fees for their children.

Nairobi Resident Magistrate L Kassan also ordered Mr Anthony Chinedu to pay other expenses for the two children, whose figures will be given when the matter is heard on March 18.

Meanwhile, Immigration Minister Otieno Kajwang has been asked to review intelligence reports that led to issuance of a deportation order against the businessman.

"A person whom security intelligence said is not fit to be in the country continues to find sanctuary and carry on his business under the watchful eye and protection of security apparatus and immigration officials," said Akinyi’s advocate Anthony Oluoch in a letter to the minister.

Visa expiry

"If indeed, as you indicated in your statement, Chinedu had six months left on his visa, and which in our calculation was from June 24, 2008 and expired in December 2008, on what basis or status is he staying in Kenya?" he asked.

The minister was quoted in a section of the media saying it would be wrong to bundle out foreigners who are in Kenya legally. According to an affidavit filed in court by Senior Immigration Officer Dume Wanda, the ministry received classified information from police that the businessman was allegedly involved in crime.

"The ministry received classified information from the police that he is one of several foreigners involved in serious crimes involving narcotics and money laundering," Wanda said.

Former Immigration minister Gideon Konchella issued a deportation order in respect of Chinedu on June 19, 2007.
