Chinedu seeks direction over property in dispute

Businessman Anthony Chinedu and his estranged wife Joyce Akinyi are back in court to seek a way forward on a winding-up petition instituted on their Deep West resort.

The two did not agree on the way forward into the case as Ms Akinyi, through her advocate, was of the view the matrimonial dispute should be resolved first.

Mr Chinedu, who instituted the winding up petition, argued that it was the core of everything and wanted it resolved first.

Commercial Court Judge Luka Kimaru advised that it would be better if all suits relating to the two were heard by one judge.

"What you counsel are doing is litigation by instalments, which will only waste judicial time," Kimaru said.

He referred the parties to appear before presiding Judge Muga Apondi on Friday for further directions.

In the petition, Chinedu says the relationship between him and Akinyi has irretrievably broken down and the company cannot reasonably function in such an atmosphere.

He says they are the only shareholders and directors of Deep West, which was principally incorporated to earn the family income.

Akinyi has raised a preliminary objection to the winding up petition. She says the application was not brought to court in good faith.
