High Court nullifies election of Gatundu North MP

Gatundu North Member of Parliament Clement Waibara has lost his seat after the High Court nullified his election over 2007 poll irregularities.

The legislator becomes the 12th MP in the Tenth Parliament to lose his seat following a petition filed by Bernard Chege Mburu.

Mburu, a voter claimed in court that Waibara was a school dropout and a friend did his language proficiency test on his behalf.

Justice Fred Ochieng’ in his ruling said the Electoral Commission of Kenya which presided over the 2007 election failed to discharge its duties lawfully since the presiding officer did not sign Form 16A as required.

This comes barely two weeks after another MP, Kitutu Masaba’s Walter Nyambati lost his seat after Kisii High court nullified his election.

Kisii Resident Judge Milton Makhandis in delivering the ruling said that the MP was elected irregularly over claims of reported anomalies.
