Khalwale loses his seat

Ikolomani MP Dr Bonny Khalwale has lost his seat at the National Assembly.

This comes after the High Court ruled on a petition challenging his election as Ikolomani MP on Friday morning.

Kakamega High Court judge, Justice Isaac Lenaola, issued the judgement after reading submissions presented by the three counsels.

Justice Lenaola settled on Friday’s date after lawyers Julie Aulo, Stephen Mwenesi and Gabriel Mukele gave their final submissions last December.

The MP, who is known for spectacular bull-fighting events, was until Friday morning, the Public Accounts Committee chairman.

Through lawyer Mwenesi, the petitioner Ben Shinali had cited electoral malpractices in the 2007 Ikolomani parliamentary election and urged the court to nullify the whole process.

Shinali told the court that he was eager to see fair and proper election conducted in Ikolomani constituency.

He had argued that there was non-compliance with the constitution in as far as the defunct Electoral Commission of Kenya managed the elections.

Mwenesi also accused Khalwale of failing to uphold the principles of law.
