Moses Kuria wants TNA to terminate incitement charges against him

Controversial Gatundu South MP Moses Kuria has demanded that the incitement charges against him before The National Alliance party’s disciplinary committee be terminated.

Kuria made the application for termination Tuesday morning when he faced the committee at the party headquarters in Nairobi.

TNA Disciplinary Committee member Johnson Omboga said the fate of Kuria's case will not be known till Friday evening when ruling on the matter will be made.

Through his lawyer Danson Mungatana, the MP, known for his acerbic public statements, argued that he faces the same charges of incitement in the High Court. 

“We cannot have two proceedings against Kuria over the same charges. We have called on TNA Disciplinary committee to drop this matter and let the High court process go on,” he said.

When Kuria first appeared before the committee last week, he objected to the charges saying they were vague, forcing the committee to draft them afresh.

It appears that Kuria has again pulled a surprise on the committee, which was preparing to commence proceedings against him, by making an application for termination.

If the case against Kuria proceeds and he is found guilty, he may be expelled or suspended or compelled to issue public apologies or pay fines.

Mungatana accused TNA Chairman Johnstone Sakaja of referring Kuria to the TNA disciplinary committee when he himself was in violation of the party’s Constitution.

“The Chairman is illegally holding both a public and party position. He does not have any moral authority to lecture anyone about party discipline,” he said.

He added: “The Chairman has said publicly several times that the party would use Kuria as a lesson which means there is no fairness in this process.”
