Kilgoris father sentenced to life imprisonment for defiling two year old daughter

NAROK COUNTY: A Kilgoris court has committed a father to a life sentence for incest.

Thomas Ogega 25, who the prosecution claimed committed the act to his two year old infant on March 30 this year at Magena area in Kenyenya Sub County of Kisii, was convicted Tuesday by the Kilgoris Resident Magistrate Monica Munyendo.

The infant's mother had earlier told the court that on the day her husband committed the offence, she woke up and went to collect some clothes from a tailor's shop but when she went back she found him naked with the infant who was also naked crying in pain.

She added that she screamed prompting neighbours to arrive, arrested him and over handed over to Magena Police Patrol Base.

Their infant, she said was later taken for treatment to Ogembo District Hospital where medics confirmed that it was indeed defiled, charging that prior to the day her husband committed the offence, he had been inserting his index finger on its private parts.

"Before he did what he did, he had been inserting his index finger in the infant private parts. I saw him doing so but I didn't know it would lead to this shameful event," he told a hushed and a shocked court.

In mitigation, Ogega denied committing the offence, charging that his wife decided to fix him after he found her with another man in a secluded place and questioned what they were doing.

"I didn't do what I'm accused of. I have had long standing differences with my wife who decided to fix me. Before I was arrested, I had found him with another man who neighbours claim to be her friend," he said.

Munyendo said pieces of evidence that had been presented to the court overwhelmingly proved that he committed the offence, adding that she had committed him to life imprisonment to punish him and to deter cases of inhuman treatment to children.

In the same court a suspected poacher was charged with being in possession of 13 kg of elephant tusks worth Sh2.6 million.

Sampero Reyia was accused of possessing two elephant tusks on September 27 this year at Kerinkani area, Trans Mara West Sub County in Narok County.

He was also accused of dealing in a wildlife trophy contrary to the Wildlife Conservation and Management Act.

Reyia who was unrepresented, however denied the charges and was remanded until today when the court will decide on his bond application.
