Supreme court clarifies that death penalty according to Muruatetu decision is not outlawed in Kenya

The decision by the supreme court to outlaw the death sentence in the Francis Muruatetu case in December 2017 will only apply in murder cases. In its inaugural ruling since justice Martha Koome took over as chief justice and president of the supreme court, the court said the Muruatetu decision did not outlaw death penalty or invalidate mandatory sentences or minimum sentences in the penal code, the sexual offences act or any other statute. Offenders subject to the mandatory death penalty are entitled to sentence rehearing.
