Nairobi businessman Praful Kumar will have to spend the night in remand again after a ruling on whether he is to be released on bond or not was postponed until tomorrow morning.

Kumar has been in police custody since Monday night when he was arrested and the two parties have been deliberating whether the state breached the 24 hour period within which a suspect can be arraigned in a court of law.

In his judgment, senior principal magistrate Henry Nyakweba said that the state was within the law since Tuesday was a national holiday. The prosecution is also opposed on his release saying he may tamper with the ongoing investigations.
