It is now emerging that the Rawal ruling was followed by heated email exchanges between Chief Justice Willy Mutunga and fellow Judge Njoki Ndugu. Email communication seen by KTN news paints a picture of a sharp disagreement between the two judges on how the case was handled. In one email the CJ admonishes Njoki Ndugu for unilaterally suspending the court of appeal ruling. Justice Ndungu in turn accuses the CJ of attempting to muzzle her independence.
