The high court has referred the case against Deputy Chief Justice Philomena Mwilu to chief justice David Maraga. High court judge Chacha Mwita is asking the chief justice to constitute a three-judge bench to hear the matter.

 While making the ruling, justice Chacha Mwita also extended the conservatory orders following an application by the director of public prosecutions, barring Philomena Mwilu from prosecution.
