Judicial Service Commission (JSC) promises to give Judge Njoki Ndung'u a fair hearing

The Judicial Service Commission (JSC) has promised to give Supreme Court Judge Njoki Ndung'u a fair hearing while investigating her conduct.

Justice Ndung'u lodged an urgent application at the High Court complaining that a special committee of the JSC had proceeded to investigate her but did not invite her to defend herself.

This came after former Law Society of Kenya Chairman Apollo Mboya filed a petition before JSC seeking the removal of three Supreme Court judges on allegation that they had refused to offer judicial services.

Chief Registrar of the Judiciary Anne Amadi said: "JSC intends to provide Judge Ndung'u with opportunity to be heard in the event Mboya's claims leads to the appointment of a tribunal to investigate her conduct."

Mboya said Ndung'u engaged in misconduct by issuing a ruling on judges retirement age, yet there was a conflict of interest on the matter.
