A woman who was accused of breaking a minor’s arm after he drove cows into her sweet potatoes farm has been acquitted.

Margaret Ashono was sentenced to three-year probation in Bungoma but challenged the ruling in court.

The complainant told the court that he was herding cows when Ashono whipped him twice on his buttocks and squeezed his right hand. He was taken to Makutano Dispensary and later Elgon hospital.

Ashono was dissatisfied with the judgment and appealed on grounds that the trial court failed to consider the evidence on record and that the three -year probation period was excessive.

A medical doctor who examined the boy confirmed from the treatment notes and P3 form that a fracture had been sustained, but gave contradicting dates.

 Thus: “The above contradiction cast doubt as to what exactly the injuries if any sustained” and “Consequently, the appeal succeeds. The conviction is quashed, the sentence set aside,” partly reads ruling that acquitted Ashono.
