Court dismisses case against removal of NTSA boss Njao from office

The Employment and Labour Relations Court has dismissed a case seeking the removal of National Transport and Safety Authority (NTSA) Director General George Njao.

Justice Byram Ongaya yesterday ruled that the application was an abuse of the court process, as similar orders were previously adopted in court in February 2023.

"The application is frivolous, vexatious, and blatant abuse of the court process," ruled Ongaya, noting that the petitioner should have appealed the earlier ruling if he was dissatisfied.

The petitioner, Edwin Oduor filed a notice of motion seeking to oust Njao from office, on grounds that the position was not competitive and that the Agency had failed to manage runaway accidents on the roads during Njao's stint in office.

Controversy marred Njao's tenure, with questions on whether he was eligible for an extension, following the lapse of his term in 2022.

He was appointed for a three-year term in 2019.

"Issues raised therein having been dealt with exhaustively and settled in a court ruling on Feb 10, 2023, which has neither been appealed against nor reviewed by any court," said Justice Ongaya.

The court further dismissed the application with costs.
