Brookside pays Nyali MP Mohammed Ali Sh500,000

The Brookside Milk company has paid Nyali MP Mohammed Ali Sh500,000 after he wrote to them seeking to auction their property over the debt.

The legislator got a nod from the High Court to auction property belonging to the company after they were ordered to pay him Sh502,501 after losing a defamation case.

"As a matter of abundant caution, and in the event the ex-part order are not granted we hereby enclose our cheque in the sum of Sh579,126 towards the payment of the figure stated in the said proclamation," Brookside said in a letter to Ali's lawyer Adrian Kamotho.

"This payment is made without prejudice to the said application and in any event without admission of the validity of the said proclamation."

In a letter to the company, Ali through Fisra Auctioneers sought to auction at least 40 cows valued at Sh150,000 each.

He also sought to seize a cooling plant valued at Sh400,000, computers valued at Sh20,000, printers (Sh14,000), seven reception seats (Sh6,000), office desks (Sh30,000) and office chairs (Sh20,000).

The company which is associated with former President Uhuru Kenyatta sued Ali in July 2022, claiming that he uttered false utterances therefore infringing on their right to do business in the country.

They claimed that Ali allegedly told a political rally in Nyeri County on March 3, 2022, that Brookside buys milk from farmers at Sh20, boils and thereafter sells it to suppliers at Sh120, a statement they say was false.

Justice Hedwig Ong'undi, in October 2022 struck out the case after finding that the claim was filed in the wrong court Constitutional and Human Rights Division.

Her decision came after Kamotho challenged the powers of the Constitutional and Human Rights Division court to hear and determine the case.
