Nyali MP Mohammed Ali goes after Brookside cows to recover Sh0.5 million

Nyali MP Mohammed Ali wants to auction at least 40 Brookside Dairy cows to recover part of the Sh0.5 million the company owes him.

This is after the High Court in Nairobi allowed him to seize and auction property belonging to the company over a Sh502,501 debt.

The debt arose from a defamation case that was filed by the milk company against the MP where they also sought to gag him.

Brookside claimed that Ali uttered false utterances that it was exploiting farmers during a political rally in Nyeri County on March 3, 2022, by claiming that they buy milk from farmers at Sh20 and thereafter boils it before selling to suppliers at Sh120.

The company lost the case and was ordered to pay Ali the costs of the Suit.

The company which is associated with former President Uhuru Kenyatta went to court in July 2022 seeking to be paid an unspecified amount of money in damages by the MP following his utterances.

Justice Hedwig Ong'undi, in October 2022 struck out the case after finding that the claim was filed in the wrong court Constitutional and Human Rights Division and awarded Ali the costs.

She delivered the ruling after Ali through his lawyer Adrian Kamotho filed an objection challenging the powers of the Constitutional and Human Rights Division court to hear and determine the case.

Ali downplayed the allegations that he had violated the company's right to do business in the country through his utterances.

He has engaged the services of Fisra Auctioneers to carry out the seizure and auction of the property.

Fisra also wants to seize a cooling plant in Mundoro, Gatundu South, Kiambu county valued at Sh400,000, computers valued at Sh20,000, printers (Sh14,000), seven reception seats (Sh6,000), office desks (Sh30,000) and office chairs (Sh20,000).
