Senator Mungatana loses Sh76 million case against a Chad national

Tana River Senator Danson Mungatana has lost his bid in a case where he was seeking to have a Chad national jailed over Sh76 million investment in an oil business.

The accused, Abdoulaye Tamba Kouro has been acquitted on one count, of obtaining money by false pretence from Mungatana, among four others in 2018.

Milimani court Magistrate Ben Mark Ikubi said in his judgement that the prosecution find evidence to support a charge of obtaining money by false pretence by Kouro from Mungatana.

The prosecution did not call a witness to testify that indeed Mungatana gave USD 1 million equivalent to Shs76 Million to the accused.

"Mungatana too didn't indicate whether when he visited the accused in his houses in Kilimani and Westlands was accompanied by bodyguards but they didn't see him giving money to the accused," said the Magistrate.

However, the court found the accused guilty on account of being in possession of fake US dollars and Euros equivalent to Shs960 million.

Kouro was found guilty of another count of receiving money by false pretence from another victim Makau Muteke which the magistrate said enough evidence was proved by the prosecution.

The prosecution had called seven witnesses during the trial and Mungatana was the first prosecution witness.

The prosecution applied to have a presentencing report prepared and the matter be mentioned on November 9 to confirm whether the report has been filed.

The accused will remain in prison until then.
