Starehe Member of Parliament Charles Kanyi Njagua aka Jaguar on 27 October moved to the court to seek the Independent Electoral and Boundaries Commission (IEBC) to declare President Uhuru Kenyatta winner of the repeat presidential elections without results from all the constituencies.
The Starehe MP also wanted the court to
stop repeat elections in Migori, Homa Bay, Kisumu and Siaya counties stating
that it will lead to confusion. IEBC Chairman Wafula Chebukati had previously
scheduled the repeat election in the four counties on Saturday 28 October but postponed
them on Friday citing violence in the counties. The IEBC Chairman did not give a specific date
for the repeat election.
MP Charles Njagua through lawyer Duncan Okatch, said that the four counties already openly stated that they will not participate in the election. He insisted that IEBC will be violating the rights of others if they conducted the elections in the four counties.
“Insisting that on conducting repeat elections in constituencies where voters have openly indicted that they shall not participate but thwart attempts to hold the election will be a violation of rights of others,” said Lawyer Okatch.
National Super Alliance (NASA) leader Raila Odinga during his interview with CNN on 27 October termed the just ended repeat poll as a sham saying that only 3.5 million people participated in the election. He said that the government was trying to doctor the figures to increase the numbers.
