Kerugoya, Kenya: A case challenging the impeachment of Embu Governor Martin Wambora has been referred to Chief Justice Dr Willy Mutunga.
Lady Justice Cecilia Githua sitting in Kerugoya referred the consolidated case to the CJ to form a constitutional bench to hear the application by Wambora and his Deputy Dorothy Nditi.
She also ordered that all the respondents in the suit file their replying affidavits within the next two days.
Githua said due to the urgency of the matter and the public interest it has generated, it should be heard and determined expeditiously.

She said the bench would be able to interpret the constitutional implications of article 181 which only speaks on the impeachment of the Governor but remains silent on the deputy governor.
The two leaders have moved to court challenging the legality of the recent impeachment proceedings against them by the Embu County Assembly.
“Due to the weighty issues in this matter, it is only fair that the constitutional court hears and determines all the three consolidated cases within the shortest time frame possible,” Justice Githua said.
She said the three bench judge should be constituted urgently hence her orders that all the respondents to file their replying affidavits within the next two days.
The Judge further directed that all the three files consolidated cases be taken to the Constitutional court in Nairobi immediately where the replying affidavits will be filed.
