Embakasi East MP Babu Owino risks losing his seat after failure to respond to an election petition on time filed by his competitor Francis Wambugu Mureithi.

Mr Wambugu, filed a petition on 7 September at the High Court to challenge the win of the Embakasi East MP during the August 8 elections.


Mr Owino was supposed to respond to the petition within seven days which he failed to do. The court has nullified the election and ordered a re-election since the deadline lapsed on Friday 15 September. 


"The respondents have refused, neglected and failed to file their notices of address of and response to the petition within the prescribed time of law," read part of the notice from the Court.


Babu Owino and the IEBC's failure to respond in time made it easy for the court to rule in the favor of Mr Wambugu.

The Embakasi East MP on his Facebook page, has however said that he filed his response within the stipulated time.

"I filed my response within the stipulated time and treat the rumors being peddled by my opponents with the contempt it deserves.tibim," he posted.
