The case comes after footage was revealed earlier this week of a different couple having sex on a subway escalator.
A passer by filmed the x-rated scene, which showed a woman bent over the side of the escalator completely oblivious to the people coming and going.
The couple continue romping before being stopped by a member of the public who kicks the man in a bid to stop the public indecency.
The shocking footage then shows the woman turning round - to reveal a child strapped to her front.
The alarming footage has gone viral on the internet.
