A nation becomes great depending on the character of its citizens. In the same vein, a good Constitution is only effective if the citizens are eternally vigilant and exercise their rights.
Ordinary citizens have often failed to stick and exhibited sheer ignorance on the very basics of law. Due to the ignorance, the elites have exploited the situation to abuse the authority entrusted to them. Kenyans are mandated to ensure those in power respect the Constitution. The threshold for accountability has been raised for all public servants.
For the first time an ordinary citizen has challenged the decision of the highest court in a very fundamental way. Okiya Omtatah compelled Supreme Court judges, including the Chief Justice, to disqualify themselves from the case hearing Kalpana Rawal and Philip Tunoi retirement age dispute, citing conflict of interest.
Consequently, Tunoi and Rawal were forced to retire. This is quite impressive. Ordinary people have power under the law to make a difference. We must all be part of the change process. Congratulations Mr Omtatah for showing us the way.
