A High Court has ordered that a man accused of sexually assaulting his 11-year-old daughter be tried afresh.
Justice Kanyi Kimondo issued the order nine months after the case against the suspect, named in court papers as JNM, was withdrawn.
Justice Kimondo’s order followed an application by Murang’a County Children Services Department challenging a decision by Senior Principal Magistrate Edwin Nyaga to free the suspect.
Justice Kanyi said the matter can be heard by any magistrate except Nyaga. He directed that the suspect takes a fresh plea.
