Robert Burale has suffered a significant setback after a Nairobi court rejected his application to compel the removal of a controversial interview made by his former wife, Rozinah Mwakideu.

The YouTube interview published on 4 October by Rozinah’s brother, Alex Mwakideu quickly gained attention, accumulating hundreds of thousands in views. 

Rozinah described her marriage as a dark chapter of her life, saying: “My biggest mistake in life was marrying Robert Burale… my darkest period was being with him.” 

On Tuesday, 28 October, at the Milimani Commercial Magistrates’ Court, Chief Magistrate Thomas Nzyoki declined Burale’s request to delete the already-published material. 

Instead, he issued an interim order restraining the Mwakideus from any further publication of the interview or related content until the matter is fully heard. 

“An order for interim injunction is granted to stay the defendants (Alex and Rozinah Mwakideu) from any further publication of the complained video on any social media platform pending the hearing and determination of the application,” ruled Magistrate Nzyoki. 

Burale’s original court papers, filed on 8 October, sought a full takedown of the YouTube video, removal of all copies of the content, a formal apology, and general and aggravated damages totaling KSh 20 million. 

He alleged the interview contained numerous false and defamatory claims, including accusations that he was “manipulative, hypocritical, a swindler and homosexual.” 

During the initial hearing, the Mwakideus’ legal team raised jurisdictional concerns, prompting the court to transfer the case to a Chief Magistrate’s Court for proper jurisdiction before any substantive orders can be made. 

Alex Mwakideu has publicly denied that the interview was designed as a setup against Burale. 

According to him, he was not fully aware of the details Rozinah revealed. “I did not know many of the details Rozina disclosed. I never planned a setup.”

Meanwhile, Rozinah has said her goal was simply to share her personal story rather than exact revenge. “I have healed, I have moved on… This is my story and I just wanted to share it,” she said in a later video.
