High Court judge David Majanja has declined to issue orders to stop the Senate from publishing a gazette notice on the impeachment of Martin Wambora as Embu governor.
The Council of Governors (CoG) moved to the court yesterday afternoon to challenge Mr Wambora’s impeachment on grounds that the Senate proceedings were conducted in contravention of orders issued by the court.
The petition was heard before Justice Majanja who referred the case to the Kerugoya High Court where the Chief Justice has constituted a three-judge bench.
CoG wanted the High Court to issue orders for Wambora to remain in office until the judges determine otherwise.

Majanja said: “This file is hereby taken to the CJ to refer the matter to the three-judge bench sitting tomorrow.”
