A Sudanese man facing defilement charges will remain in custody for three months until his case is determined by the High Court.
Makoy Madhack Deer, 30, whose Sh1million bail was cancelled, is accused of defiling a five-year-old girl in Nyayo estate on March 3.
Making the ruling, Justice Luka Kimaru said defilement case is a serious matter and that Kenya and Southern Sudan have no extradition treaty. This, according to the judge, would make it difficult to arrest the accused should he jump bail.
Further, he noted, Madhack did not have any home in the country, hence it was safe to keep him in custody.
Madhack, a father of one, is reported to have inserted his penis in the minor’s mouth.
