Five Coalition for Reform and Democracy (CORD) legislators have denied they linked former Inspector-General (IG) of police David Kimaiyo and Director of Criminal Investigations Ndegwa Muhoro to the Karen land grab.

In response to the suit by Kimaiyo and Muhoro, senators James Orengo, Johnstone Muthama, Boni Khalwale, Elizabeth Ongoro and MP Junet Mohamed say they never defamed the two security bosses in a press statement where they were complaining about grabbing of the 134-acre piece of land.

The five legislators in their court papers say their statement issued last year was not defamatory adding they were just raising a fair comment on the failure by the IG and the Director of Criminal Investigations to apprehend the people behind scam.

Defence’s arguments

“Ever since allegations were made against the persons who have designed and executed the land grabbing the subject matter of the statement, the First and Second Plaintiffs (Kimaiyu and Muhoro) have taken no known action on this matter in contravention of their constitutional duties as Inspector General of the National Police Service and Director of Criminal Investigations,’’ the legislators argue in their papers filed by Anthony Oluoch and Company advocates.

Messrs Orengo, Muthama, Khalwale, Junet and Mrs Ongolo said that they did not issue any statement that harmed or ridiculed the security bosses adding that the two should prove that they suffered losses due to their utterances.

The five were accused of suggesting Kimaiyu and Muhoro had been involved in land grabbing and that they could not be trusted with public offices.
