The High Court will rule on a petition by Nyeri Town MP Ngunjiri Wambugu seeking a determination on demonstration zones.
He wants the court to grant Interior Security Cabinet Secretary Fred Matiang'i powers to prescribe demonstration zones and have the National Super Alliance bear the cost for destruction of property.
If the orders are granted, demonstrators would also have to seek the consent of businesses and individuals adjacent to the demonstration zones before picketing.
Mr Ngunjiri, through lawyer John Njomo, argues that the right to demonstrate was conditional on the demonstrators doing so peacefully and unarmed.
