A parliamentary aspirant in the 2013 polls has lost an appeal in the Supreme Court against a judgment which revoked his election.
Chris Bichage, who vied for the Nyaribari Chache constituency seat on an ODM ticket, has been in court fighting his opponent, current MP Nyagaka Tong’i. The five-judge bench dismissed the case on grounds that it was time barred.
Deputy Chief Justice Philomena Mwilu, Justices Isaac Lenaola, Njoki Ndung’u, Smokin Wanjala, Jackton Ojwang and Mohamed Ibrahim declared that after the Court of Appeal made its decision, a by-election was conducted which culminated to another process which was not be contested.
