David Waihige Mwaura wants PSC stopped from handing over the names of the applicants to the National Assembly for vetting.

Mwaura, who says he heads Agano Party, has also applied for the position to head the anti-graft body.

Because of his political position, he says, he expects his application will be rejected unless the case is heard urgently.

He suspects his name could have been left out of the list forwarded to Parliament by PSC for the same reason.

If the matter is heard urgently, Kenyans, including members of the governing body of a political party, will have an equal opportunity to apply for the position of head of the EACC, he said.

"Delay in the hearing and decision making would be prejudicial to the legitimate expectations of the subjects of the petition and members of a governing body of a political party," he said.
