Mumias Sugar Company Managing Director Dr Evans Kidero received a setback when the Bungoma High Court declined to have his name expunged from a case.

Making the ruling, Judge Aggrey Muchelule said that he couldn’t see the reason why Kidero’s name should be expunged from the case challenging the sale of the controversial Nasewa Sugarcane factory land in Busia County.

Muchelule said the sugar company MD had signed the affidavit that sanctioned the sale of the land measuring 842 hectares.

He directed that a full hearing for the case commences on July 2.

Through his lawyers, Kidero had sought for orders from the court to remove his name saying the case was politically motivated.

The ruling gives way for the full hearing of the case in which Busia sugarcane farmers have cried foul over the illegal sale of the land belonging to them.

The land was put on sale after the directors of Busia Sugar Company allegedly failed to repay Mumias Sugar Company a loan amounting to Sh110 million prompting the sugar firm to move to court seeking orders to sell the land in order to recover the money.
