Over 600 families living around the Ngong Hills forest have received a reprieve after the high court requested Chief Justice Willy Mutunga to appoint a three-judge bench to hear their petition against an eviction notice issued by the Kenya Forest Service two years ago.The families are seeking to uphold their right to stay on the 3000 hectare land based on a crown law of 1949 and trust land law of 1963 ... the families say that in 1982 former president Daniel Arap Moi set the land aside for a human settlement and grazing and in 2005 President Mwai Kibaki confirmed the status. Lady Justice Mumbi Ngugi ruled that the case had weighty issues and directed that it be heard before a 3 judge bench.
