A Jubilee Member of Parliament has accused Chief Justice David Maraga of having secret phone calls with Raila Odinga’s lawyers during the presidential election petition at the Supreme Court.
Leading a seven bench Judge last month, CJ Maraga made history in Africa, nullifying presidential results and ordering for a fresh election.
The Independent Electoral and Boundaries Commission announced that the repeat election would be held on 17th October 2017.
Nyeri town MP Ngunjiri Wambugu filed a petition to the Judicial Service Commission in an attempt to oust the Chief Justice.
The MP said that Maraga interacted with Raila’s lawyers unprofessionally during the presidential election petition hearing.

He accused Maraga of gross misconduct, saying that the secret phone calls somehow influenced the outcome of the petition.
“Those contacts were unprofessional. The Chief Justice also concealed those conversations from the other parties in that presidential petition in breach of The Judicial Code of Conduct & Ethics.
It behooves upon the Judicial Service Commission (JSC) to seek from the relevant telecommunication operators, a complete call log of the Chief Justice’s telephone numbers and a breakdown analysis of the calls made to and from the said numbers during that period outlining the frequency and duration of the calls,” said Wambugu
He also added that the Chief Justice unconstitutionally invalidated the presidential election results – conspiring with Civil Society members to rebuff Uhuru Kenyatta’s win.
